The affiliation of teachers grows by 7.4% compared to last year after the offensive to end hiring in law fraud in private schools and academies

Something seems to have changed in the education sector since the Ministry of Labor began sending letters to private schools and academies last June to try to end the massive dismissal of teachers before the holidays and their subsequent recruitment since September to save a few months of salary and contributions to Social Security.

According to the data of affiliation to the system corresponding to the month of October, the discharges of workers within the educational sector -from child educators to professors of academies or universities- shot up 7.42% with respect to the same month of 2017 within the General Regime, where they work as employees, and just over 6% in the Special Regime of Autonomous Work (RETA).

Do not forget that employment in this sector always picks up in October. However, in the Ministry of Labor estimate that this increase is more intense than usual and, without total certainty, consider that behind may be the tasks of the Labor Inspection.

The Social Security sum 130,360 affiliates in the best October in history
The Labor Force Survey (EAPS) corresponding to the third quarter was encouraging, as it showed a stagnation in employment that could be read as a parenthesis in the slowdown. The[…]

On the one hand, enrollment in education within the General Regime grew by 19.2% in the month of October compared to September, with 148,049 more workers. This figure exceeds the net increase in enrollment in the same month of 130,360 people, and increases the number of employees in the education sector (totaling public and private sector) to 917,913 employees.

This rate of advance does not differ too much in relation to the year 2017. Then, the inter-monthly increase was 19.12%. On the other hand, if we look at the annual evolution, membership grew 7.42% last October, compared to the 5.3% rate of a year earlier.

This same effect was seen already in the month of September. The education sector increased its membership by 53,308 people compared to August, also with an increase of 7.4% more, being one of the mainstays of the recovery of employment in that month and offsetting the decline in activity in the hospitality and retail .

Months before, since June, employment in this sector had only regressed coinciding with the end of classes, after the last rebound in May.

The increase is not explained by the cycle
It is true that the situation has changed from one year to the next and that this could explain this change of pace. However, if the explanation is sought in the economic environment and in the general evolution of Social Security affiliation, the data suggest that the evolution of Social Security registrations should have been the opposite, tending to slow down .

If you take the average annual growth of enrollment in teaching the entire General Scheme, this was 3.4% last October, half a point less than the rate above 4% that marked last year in the same month.

The same happens in the autonomous system, in which last year there was an increase of 6.39% in the inter-monthly rate, a rate similar to that observed this year, but with an advance of 3.6% in the interannual rate that already in 2018 it has doubled to exceed 6%.

First impressions of Work
In view of the data, the Secretary of State for Social Security, Octavio Granado, pointed out in a press conference that, although the current situation of employment in the education sector «is not completely known», it has been detected that «The increase of workers (in the sector) is very high». Hence, without taking anything for granted, has issued a first trial: «I do not think that in all centers there are 7% more people working. I can be wrong, but I think that after many have received the notice of the Inspection has added more diligent compliance obligations.

Private schools and academies, in the focus of fraud in teacher hiring
The summer holidays available to Spanish teachers are no longer envious. The widespread practice of firing them with the arrival of the summer season and […]

«At the moment, simply with the announcement of actions may the sector is increasing membership,» he added.

Would this also affect the self-employed? Possibly too. Granado has detailed another of the practices that could be considered fraud of Law occurs, not in private schools or academies, but in teaching cooperatives, in which workers are supposed to voluntarily register and discharge.

The Secretary of State for Social Security has assured that they have been detected the same movements of entry and exit of employment in these cooperatives which, following the same logic as for the General Scheme, would explain the rebound of the employment of teachers among the collective of the self-employed. Private schools, to be examined In parallel to all this movement of Social Security registrations in education, the Labor Inspectorate is developing a campaign, launched since June, to dismantle the fraud that every summer occurs in the sector, in the same way that it is focusing on other sources of irregularity such as meat companies or the hiring of false self-employed. Social Security loses almost 600 million each year by false self-employed False self-employed make Social Security fail to enter more than 592 million euros a year, as shown by a study carried out by the union of […] As a starting point, a ruling of the Supreme Court of last June 11 forbade trying to different way to career teachers and interns who develop their functions during the entire school year. The ruling pointed out that both are equal in remuneration rights, so they must receive the salaries corresponding to the months of July and August. Then, the Ministry of Labor decided to transfer the effects of the sentence also to the public sector with the conviction of that a good part of these practices was located in private schools and academies.
