A neighbor filed a complaint in the apparent municipal inaction regarding a bar, owned by two brothers of a councilor

The Court of First Instance and Instruction number 6 of San Javier, headed by Judge María José Araix, has opened criminal proceedings against the mayor of Los Alcázares, Anastasio Bastida, and against his councilor of Commerce, Francisco Méndez Heredia, with the In order to determine if they have been able to illegally favor the owners of a downtown coffee shop. It is the circumstance that the two hoteliers are brothers of the aforementioned mayor, which is precisely who has the powers over these types of establishments.

The opening of the investigation is based on the complaint filed by a neighbor of the area, who for five years is trying to find out if the premises have the appropriate permits and authorizations to have a terrace that completely blocks Santa Teresa street and that, because it apparently has a rigid structure, it is not collected at any time and completely blocks the aforementioned traffic. All the steps taken by this citizen over the past five years have met with an absolute lack of response from the municipal authorities, who would not even have offered an answer. Faced with that apparent inaction of the Maritime Consistory, the affected party has ended up presenting a complaint in the courts of San Javier for alleged crimes of prevarication, influence peddling and against the ordination of the territory, which has just been admitted for processing.

The judicial action is also directed against the owners of La Tropical coffee shop, who have installed the covered terrace on that street, as well as against two municipal technicians who also would not have acted in response to the complaints and claims presented by the complainant.

Cited with their lawyers
In a car dictated by Judge Araix, whom ‘La Verdad’ has had access to, Mayor Bastida, Councilman Méndez Heredia and the two municipal officials, as well as the two restorers, are summoned to appear in court to give a statement as defendants; that is, assisted by a lawyer. He also cites several witnesses, including a councilor of the PSOE and a mayor Citizens who apparently could consult at some point the municipal file on the aforementioned terrace and also could provide some information on the attitude of municipal officials regarding of that installation.

Similarly, the instructor urges the City to deliver, within a maximum period of ten days, the entire file on the terrace and report if there is a municipal resolution to restrict traffic Santa Teresa Street, if there is authorization to occupy that road , if any type of report has been issued on the access of emergency services and evacuation routes and, finally, of the proceedings, files or sanctions that may have been processed against the premises.

The mayor of Alcazara assured yesterday that this newspaper had no record of the complaint or the opening of proceedings and said that «at this time, I do not know the specific situation of that terrace, because I also have delegated those powers.» He did indicate that the question of the occupation of the street «has been addressed in plenary on some occasion and it has been stated that everything is in order.»

Bastida said that this installation is more than fifteen years old, so the authorization would date from the times of the socialist government.

Yesterday afternoon, he tried to talk with the owners of the establishment, but could not locate them.
