The irrigators of Molina will have to return a grant of 1.2 million

The Recurring Inheritance of Molina de Segura (Murcia) will have to return 1.2 million of the subsidy that it received for the modernization of irrigation due to not having proceeded to carry out the works within the foreseen term.

This is reflected in a ruling of the Contentious Chamber of the Superior Court of Justice (TSJ) of the Region of Murcia that dismisses the appeal that this farmer organization filed against the orders of the then Ministry of Water, Agriculture and Environment of 2014 that he claimed the return of the aforementioned sum.

The ruling indicates that the regional administration demanded the delivery of the 1.2 million grant when it verified that after several postponements the works had not been executed.

It also indicates that «for the technical services of the Ministry, reports were issued in November 2014 and March 2015 in which it was indicated that the claimant had not only failed to comply with the requirement, but had also partially failed to comply the objectives that had motivated the granting of the subsidy ».

In its appeal, the inheritance alleged, among other considerations, that it had prescribed the right of the administration to recognize or settle the refund of the aid, in addition to the principle of proportionality being violated.

When dismissing the appeal, the Chamber says that «it is proven that the investment project amounted to 11.1 million and that the investment actually made was 6.5 million, of which 88,955 euros were invested after the end of the term of justification ».

He adds that «therefore, it can not be considered that the achievement of objectives is significantly close to the total compliance required by the principle of proportionality alleged, nor credited the intention of the appellant to comply with the commitment to execute the entire project to request the subsidy that concerns us ».
